This section contains the additional
terms and conditions for paying members. You
must agree to, and abide by, these rules if you wish
to join our site as a full member.

 |
1. Subscriptions to the UK Firework Review
grant access to the "member" area of the website
for the time period specified. All subscriptions
are payments in advance and are nonrefundable
ie. you are not entitled to a refund of the
whole or part of your subscription if you do
not access the website during your term.

2. Access to the members area will only be
granted on receipt of payment and manual authorisation
by us. We are unable to give access until full
payment has been received however your term
only starts from when access was granted and
not from when you applied.

3. You will require a User ID and password
(in addition to payment) to access the members
area. We are unable to give access unless you
complete "Step 1" of the application process
and create a User ID.

4. You must fill in a valid e-mail address
when applying for membership and use the same
e-mail address when making payment. This is
because we need to tie the two together and
confirmation of access is sent to that e-mail.

5. We reserve the right to refuse to grant
access to any person, for any reason, without
explanation. In this event if your payment has
been processed we will refund any monies taken,
in full, unless you were given access initially
and were subsequently barred from the site for
breaking our terms, in which case a refund would
not be given.

6. Accounts are manually activated and administered
to keep our costs to a minimum and therefore
your membership costs down. This does mean access
may not be immediate after payment. We aim to
activate all new accounts within 24 hours of
payment but please allow longer.

7. We only accept payment on-line by the methods
indicated during the join process.
|
 |
8. We understand that as a paying member you
expect the UKFR to be on-line and available
at all times. However, we can make no guarantees
as to the "up time" of the site as this is beyond
our control. For example, hosting, routing,
server, Internet, hardware and software problems
completely beyond our control may occur. We
accept no responsibility if the site goes off-line
and it is not our fault.

9. We are committed to running the UKFR but
should the site close or otherwise cease to
function intentionally at our request, memberships
will be refunded pro-rata. This is the only
occasion when memberships will be refunded.
We are not responsible for matters outside of
our control which may affect the value of our
content including changing firework legislation.

10. Memberships run for the time stipulated
when you join. At the end of this period your
membership will expire. If this happens you
will lose access to the member content however
YOU ARE UNDER NO OBLIGATION TO RENEW YOUR MEMBERSHIP.
If you wish to cancel you need do nothing. Your
card will not be rebilled automatically.

11. Referring also to the site
terms, we accept no responsibility for the
content of our site which is provided "as is"
and with no warranty express or implied. We
should point out that the reviews and all our
other content is offered as our opinion only.
All content is downloaded at your own risk.

12. We reserve the right to change subscription
prices higher or lower without notice. This
will not affect current members until their
term has expired. Any renewal of membership
must be done at the current prices at the time
of renewal.

13. TRADE USERS PLEASE NOTE: USER ID'S
ARE FOR ONE PERSON'S USE ONLY AND MUST NOT BE
SHARED. IF YOU REQUIRE MULTIPLE ACCOUNTS OR
MULTIPLE USE OF AN ACCOUNT FOR YOUR STAFF PLEASE
CONTACT US. SHARING AN ACCOUNT WITHOUT PERMISSION
IS STRICTLY PROHIBITED.

14. ALL CONTENT IS COPYRIGHT AND MUST NOT BE
DUPLICATED BY ANY MEANS, IN ANY MEDIUM, WITHOUT
OUR WRITTEN CONSENT. This includes (but is not
limited to) reposting content from our site
on another webite (commercial or not), by e-mail,
in a newsgroup or forum, in firework catalogues
or brochures and so on. All textual information
is also covered by this including reviews or
review summaries which may not be copied or
quoted without our permission.

15. WE ACCEPT NO RESPONSIBILITY AT ALL FOR
PAYMENTS MADE ON-LINE IN RESPECT OF CARD SECURITY.
THESE ARE HANDLED BY A THIRD PARTY COMPANY CALLED
NETBANX OR PAYPAL. YOU WILL RECEIVE A CONFIRMATION
E-MAIL FROM NETBANX OR PAYPAL CONTAINING A TRANSACTION
NUMBER AND/OR PAYMENT DETAILS AND CONTACT DETAILS
IN CASE OF A QUERY. WE SHOULD STRESS THAT THE
UK FIREWORK REVIEW DOES NOT PROCESS YOUR CREDIT
CARD NOR STORE OR HAVE ACCESS TO, YOUR CARD
DETAILS. OUR ONLY INVOLVEMENT IN CARD TRANSACTIONS
IS TO FORWARD YOU TO THE NETBANX OR PAYPAL SECURE
SITE TO PROCESS YOUR PAYMENT AND THEN WE RECEIVE
CONFIRMATION FROM NETBANX OR PAYPAL THAT YOUR
PAYMENT HAS CLEARED (OR HAS BEEN DECLINED) FOLLOWED
BY THE MONIES. ALL QUERIES RELATING TO CARD
PROCESSING SHOULD BE REFERRED TO NETBANX OR
PAYPAL (WHICHEVER SYSTEM WE USE).

We reserve the right to revoke your membership, without
warning and without any refund (whole or part) if
you carry out one or more of the following activities:

16. Sharing your access with anyone else: YOU
MUST NOT SHARE YOUR USER ID WITH ANYONE ELSE.
This is considered theft. We monitor IP addresses
and will bar any accounts suspected of being
shared. Should this happen your access will
be terminated without notice or refund. May
we remind you of our intentionally low access
charges, if you know anyone else who requires
access please ask them to join. Trade members
be aware that one membership grants access to
one person, if you require access for several
members of staff, you MUST ask first.

17. Bandwidth abuse. Users who abuse bandwidth
will be removed, this includes repeatedly requesting
the same file, off-line or robotic leeching
and any other activity we deem to be contrary
to normal and reasonable use of the site.

18. Forum abuse. The forum is subject to separate
terms and conditions which you can view on the
forum page. Any members who abuse the forum
can have both forum and UKFR membership revoked.
In addition to the forum terms, we also consider
registering an additional and/or fake forum
ID or sending abusive messages by personal messenger,
as abuse of the forum.

19. Copyright infringement. The contents of
this site are copyright. This includes all content
unless otherwise noted. The contents of this
site may not be copied and republished in ANY
format, whole or in part. This includes (for
example, but not limited to) copying pictures
or video for use on another website, copying
images for use in brochures, websites or any
other medium, copying review content (narrative,
video or pictures), copying backgrounds and
borders, or any other content. Trade members
be aware that reviewing your products (or displays
etc.) DOES NOT GIVE YOU ANY RIGHTS WHATSOEVER
over such material, which is copyright to us.
For example, trade members may not publish review
narrative, pictures or video on their own webites
or brochures or any other medium, without or
permission. WE CANNOT STRESS ENOUGH TO THE TRADE
THAT ALL REVIEW MATERIAL OR MATERIAL FROM ATTENDING
AN EVENT IS COPYRIGHT UKFR AND MAY NOT BE REPRODUCED
WITHOUT OUR PERMISSION.

20. Any other activity that we consider is
detrimental to the running of the UKFR, to other
members or the pro-fireworks cause. Our decision
in these matters is final.

21. We do not see, store, nor can we access
your card details (see term 15 above).

22. Your membership details will not be passed
to any third party without your permission,
unless requested by law or a similar authority,
or an ISP or network administrator investigating
abuse of our site. The UK Firework Review is
independent from any third party company.

23. Although we do not request it at time of
joining, we reserve the right to ask you for
your full postal address and or your contact
telephone number and may refuse or cancel your
membership if you do not supply these. This
is because we have an obligation to ensuring
the security of the website and to protect ourselves
against fraud. We do not offer anonymous access.
If you supply these details, they will not be
used for any other purpose than confirmation
of your application.

24. The e-mail you enter when you join will
be used to notify you of your joining details,
confirmation of payment if applicable, and termination
of your account when your term expires. It will
also be used if we have to contact you to query
your application, your payment, or your use
of the site. We reserve the right to communicate
this important information to you even if you
opt-out of our newsletter.

25. During your use of the site, we gather
"industry standard" data from you which includes:
When you access the site, your logged ID, your
IP, your browser details etc. Our server also
maintains a server log of your access. General
data collected may be used or shared in an "aggregate"
manner, for example, to demonstrate how many
hits we have, what countries people are accessing
the site from, what browsers people are using,
what parts of the site are visited and so on.
WE NEVER SHARE ANY INFORMATION SPECIFIC TO A
PARTICULAR IDENTIFIABLE USER unless requested
by law or a similar authority, or an ISP or
network administrator investigating abuse of
our site.

26. Your IP address is recorded and stored
when you access the members area.

27. Cookies: Some parts of UKFR use cookies,
including the forum. These are intended to improve
the usability of the site or provide extra features.
We leave it up to individual members to decide
whether they wish to enable or block these.

Terms and conditions are regrettable and in our case
a reflection of issues which have occured with a very
small minority of people who abused our site in its
earlier years. We hope we have kept our terms relevant
and easy to understand. If there are any terms you
do not understand, you must clarify these with us
before joining. Our terms are binding.
We hope that you enjoy your membership of our site.
Although we run it in our spare time as a hobby we
pride ourselves on offering top quality service and
content, and have done since 1999.
UKFR itself is independent and not owned or otherwise
legally connected to, any other company.
